Kant informs us that the categorical imperative is a synthetic a priori proposition. It might be thought that Kant means thereby to say that we have an a priori rational insight, somewhat like that which Plato claimed for the Forms, into this basic moral truth. W. D. Ross had a similar view about human rational insight into certain basic moral principles, and in his book Kant's Ethical Theory he attritubes such a view to Kant.I argue that this initially plausible interpretation (...) is not correct, and that the "rational intuitionism" that it involves goes against Kant's whole approach to philosophy, in the first Critique as well as in the moral philosophy. I develop a new alternative interpretation, as follows: the categorical imperative is synthetic because it contains a claim about the causal/motivational power we have to act purely from the motive of duty, without any assistance from "sensible" or empirical motives, such as pleasure or pain. This claim, qua motivational, goes beyond the meaning of the categorical imperative considered as a mere ethical precept. It is a priori because this motive's source is the noumenal self.Hence to justify the categorical imperative is to show that this sort of non-sensible motive is or could be active in us as agents, and Kant is an "internalist": one who believes that morality and motivation are internally, analytically connected. The aim of this article is to provide a historical response to Michel Janssen’s (2009) claim that the special theory of relativity establishes that relativistic phenomena are purely kinematical in nature, and that the relativistic study of such phenomena is completely independent of dynamical considerations regarding the systems displaying such behavior. This response will be formulated through a historical discussion of one of Janssen's cases, the experiments carried out by Walter Kaufmann on the velocity-dependence of the electron's mass. Through a (...) discussion of the different responses formulated by early adherents of the principle of relativity (Albert Einstein, Max Planck, Hermann Minkowski and Max von Laue) to these experiments, it will be argued that the historical development of the special theory of relativity argues against Janssen's historical presentation of the case, and that this raises questions about his general philosophical claim. It will be shown, more specifically, that Planck and Einstein developed a relativistic response to the Kaufmann experiments on the basis of their study of the dynamics of radiation phenomena, and that this response differed significantly from the response formulated by Minkowski and Laue. In this way, it will be argued that there were, at the time, two different approaches to the theory of relativity, which differed with respect to its relation to theory, experiment, and history: Einstein's and Planck's heuristic approach, and Minkowski's and Laue's normative approach. This indicates that it is difficult to say, historically speaking, that the special theory of relativity establishes the kinematical nature of particular phenomena. Instead, it will be argued that the theory of relativity should not be seen as a theory but rather as outlining an approach, and that the nature of particular scientific phenomena is something that is open to scientific debate and dispute. Kant behauptet, daß wir nur indirekte Pflichten haben können, von Grausamkeiten und Gewalt gegen Tiere abzusehen. Pflichten dieser Art seien direkte Pflichten gegen uns selbst, um unseren moralischen Charakter nicht zu verderben, aber könnten nicht direkte Pflichten gegenüber den Tieren sein, weil Tiere keine rationalen Wesen sind. Diese Sichtweise erscheint unbefriedigend, da die Tiere die Opfer einer solchen Mißhandlung sind, wenn sie stattfindet, und die Vorstellung, daß wir keine direkten Pflichten ihnen gegenüber haben sollen, erscheint merkwürdig. Ich plädiere dafür, daß (...) Kant, durchaus in Übereinstimmung mit seiner allgemeinen Moralphilosophie, hätte ein Konzept von direkten Pflichten gegenüber Tieren entwickeln können. Ein solches Konzept wäre weitaus plausibler und hätte Kant geholfen, mit allfälligen Problemen umzugehen, die sich im Hinblick auf die Behandlung von zurechnungsunfähigen Personen ergeben, die ebenfalls keine rationalen Wesen sind, sondern allenfalls potentiell. Zwar kann Kant durchaus plausibel machen, daß es die von ihm behaupteten indirekten Pflichten im Hinblick auf Tiere gibt, aber nicht, daß unsere Pflichten gegenüber Tieren auf derartige indirekte Pflichten beschränkt sind. Kant claimed that we could only have indirect duties to abstain from cruelty and violence to animals; such duties were directly duties to ourselves not to degrade our moral character, but could not be direct duties to animals because animals are not rational beings. This view seems unsatisfactory because animals are the victims of such mistreatment when it occurs, and the idea that we have no direct obligations to them seems odd. I urge that Kant, consistent with his general moral philosophy, could have developed a view of DIRECT duties to animals. Such a view would have been more plausible and would also have helped him deal with lurking problems concerning the treatment of incompetent humans, some of whom are also not rational beings, even potentially. Kant can plausibly claim that there are such indirect duties to animals, but not that our duties to them are limited to such indirect duties. (shrink)

The first part of Immanuel Kant's Metaphysics of Morals , Rechtslehre , has usually been discussed as a political treatise. But there are parallels between law and ethics in Kant; lawgiving in either realm is a combination of precept and incentive. In works that present his core moral philosophy of inner freedom, this freedom is an internal ethical freedom based on an underlying purely moral incentive, whose adequacy is a transcendental assumption of this part of Kant's moral philosophy. But this (...) inner freedom is paralleled by Kant's account of external freedom, where our external rights, including rights to property, are secured based on the deterrent effect of punishment under criminal law for violations of the rights of others. When we look at the Rechtslehre thus as part of Kant's practical philosophy we notice: Kant's view is that the validity of a legal precept entails an adequate incentive for acting in accord with the precept. The scope of law, and hence of imputation under law, is limited in various ways by the reach of the external incentives of deterrence, including actions based on a so-called "right of necessity." There are parallels between Kant's arguments for extending the categorical imperative as a principle for the use of our freedom to ends in the Tugendlehre and to objects in the Rechtslehre . Kant's theory of punishment, though retributivist in how it assigns appropriate punishment, is teleological/deterrent in providing incentives for not violating positive laws. Zwischen Kants Argumenten in der Tugendlehre für die Erweiterung des kategorischen Imperativs als eines Prinzips für den Gebrauch unserer Freiheit durch die Annahme, daß es Zwecke gibt, die zugleich Pflicht sind, und dem Argument in der Rechtslehre für die Notwendigkeit der Anerkennung von Eigentumsrechten bestehen signifikante Parallelen. An important influence on Jean-Luc Marion’s phenomenology is the work of Swiss Catholic theologian Hans Urs von Balthasar. Marion is particularly interested in Balthasar’s ‘phenomenological’ approach to the content of Christian revelation, centered on the metaphor of the work of art. Balthasar suggests in his Theo-Logic that the early Marion ‘concede[s] too much to the critique of Heidegger,’ moving too far away from the ‘transcendental’ metaphysics of Aquinas and the classical tradition. Yet Balthasar’s criticism is premature. Rather, Marion’s work, particularly (...) his emphasis on the ‘saturated phenomenon,’ paves the way for a postmetaphysical theological aesthetics that might renew Balthasar’s project in a cultural situation ‘after’ the death of God, while simultaneously opening a space for Christian revelation apart from a certain hegemonic tradition of onto-theology. Realists about fictional entities often distinguish the properties that a fictional character has and the properties a character holds. Roughly, this is the distinction between the properties that a character really possesses and the properties it fictionally possess. But despite the popularity of this distinction in realist circles, it gives rise to a number of subtle issues about which fictional realists can and do disagree. In this paper, we aim to clarify these issues and defend three related theses. One: that (...) to say that Hermione holds the property of being female is just to say that the singular proposition ⟨Hermione, being female⟩ is true according to Harry Potter. Two: that ordinary objects can hold properties insofar as propositions like ⟨Napoleon, being French⟩ can be true according to fictions like War and Peace. Notingasurprising gap in the literature on Wittgenstein’s philosophy (p. 3), Potter sets out to treat Wittgenstein’s 1913 “Notes on Logic” (which consists of a succinct summary of the conclusions reached over this initial period) as an independent and primordial philosophical work. While it has been common for serious scholars of Wittgenstein’s Tractatus to “mine” (p. 1) his pre-Tractarian writings in search of “remarks to support their interpretations ” (p. 1) of that text, what sets Potter’s study of the “Notes” apart from previous attempts at exegesis is a methodological determination to approach the “Notes” as “if not quite … a terminus in Wittgenstein’s work then at least as worthy of study in their own right” (p. 1). An important advantage of this approach, according to Potter, is that it facilitates a clearer appreciation of Wittgenstein’s lasting insights “into the central themes of philosophical logic” (p. 262), many of which Wittgenstein himself had already grasped by 1913 and which survive subsequent rejection of some of the less plausible aspects of the Tractatus (such as logical atomism and the picture theory of propositions). By presenting these key insights as consequences of central, but only subsequently adopted, Tractarian doctrines such as the picture theory, however, traditional Wittgenstein scholarship has missed an opportunity, uniquely important in the case of his philosophy (p. 1), to elucidate them against the background of the actual historical landscape of problems, strategies, motivations, and inXuences, within the context in which they were originally formulated. This paper analyzes Kant's thesis in the Tugendlehre that there are certain ends that we are obligated to adopt. It contends that none of the three arguments which Kant advances in support of this thesis succeeds and that the attempted reconstruction by Nelson Potter likewise fails. It then maintains that the argument does work, if one brings in, as an implicit premise, transcendental freedom. Finally, it is argued that this late doctrine of obligatory ends marks a significant advance over (...) the treatment of broad duties in the Grundlegung and can serve as a basis for defending Kant's ethics against the familiar emptiness charge. Der Beitrag untersucht die These Kants in der Tugendlehre , daß es bestimmte Zwecke gibt, zu deren Verfolgung wir verpflichtet sind. Dabei stellt sich heraus, daß keines der drei Argumente, die Kant zur Stützung dieser These verwendet, durchgreift und daß der diesbezügliche Rekonstruktionsversuch von Nelson Potter ebenso fehlschlägt. Es wird weiterhin die Ansicht vertreten, daß die Argumentation dann überzeugt, wenn man die transzendentale Freiheit als Prämisse einbezieht. Travis is evidently a self-conscious prose stylist, by which I mean that he pays attention to the style of his prose, not that this style is worth emulating. On.

Jeffrey Alexander argues that despite Bourdieu’s considerable achievements ultimately his work is reductionist and determinist. He further argues that though Bourdieu is a middle range theorist he is implicitly realist in his meta-theoretical assumptions. This article accepts these conclusions but argues that Bourdieu’s meta-theoretical realism is a virtue rather than a vice and that the manner in which he is a reductionist and determinist necessitate a re-thinking of what is meant by these notions. Alexander uses Bourdieu’s concept of habitus to (...) demon-strate a fundamental contradiction in Bourdieu’s theorising. According to him habitus presents us with the oxymoron of unconscious strategisation. This article uses a discussion of habitus in order to demonstrate that in its relationship with the concept of field it instead produces a practical resolution of long standing theoretical problems concerning structural determination and human agency. It is also argued that these problems are resolved at the meta-theoretical level in the form of critical realist ontology and that it is Alexander’s misunderstandings on this level which cause him to fail to appreciate the significance of Bourdieu’s achievements. The Unprovability of Consistency is concerned with connections between two branches of logic: proof theory and modal logic. Modal logic is the study of the principles that govern the concepts of necessity and possibility; proof theory is, in part, the study of those that govern provability and consistency. In this book, George Boolos looks at the principles of provability from the standpoint of modal logic. In doing so, he provides two perspectives on a debate in modal logic that has persisted (...) for at least thirty years between the followers of C. I. Lewis and W. V. O. Quine. The author employs semantic methods developed by Saul Kripke in his analysis of modal logical systems. In "*Must* ...stay ...strong!" (von Fintel & Gillies 2010) we set out to slay a dragon, or rather what we called The Mantra: that epistemic *must* has a modal force weaker than expected from standard modal logic, that it doesn't entail its prejacent, and that the best explanation for the evidential feel of *must* is a pragmatic explanation. We argued that all three sub-mantras are wrong and offered an explanation according to which *must* is strong, entailing, and the felt indirectness (...) is the product of an evidential presupposition carried by epistemic modals. Mantras being what they are, it is no surprise that each of the sub-mantras have been given new defenses. Here we offer them new problems and update our picture, concluding that *must* is (still) strong. (shrink)

Millions of people in various parts of the world and within each country are presently surviving in categories described as “mere”, “miserable”, “idealistic”, “irresponsible”, and “acceptable”. The term “acceptable survival” is proposed as a bioethical goal of global survival, looking beyond the 21st century to the year 3000 and beyond. The frequently used alternative term is “sustainable development”, but in most contexts this is an economic concept and does not imply any moral or ethical constraints, except where these are spelled (...) out. Acceptable survival, broadly defined, means acceptable to a universal sense of what is morally right and good and what will continue in the long term. All of us ponder the big and enduring human questions—Who am I? Am I free? What should I do? What is good? Is there justice?

I argue against the assumption that the influence of non-cognitive values must lead to bad science, opening the way for the thesis that non-cognitive values are compatible with good science. This, in turn, allows us to answer feminist questions, principally, How do gender politics influence science? without (1) having to reject the question a priori because theories of science assume that political values cannot influence good scientific work and (2) having made a case for the influence of gender politics upon (...) a particular bit of scientific work, being put into the ludicrous position of saying that it is bad science after all, even though the relevant community of scientists say it is good. Nevertheless, moral and political neutrality is held to be a norm of good science and a tacit metaphilosophical norm governing good philosophy of science, viz., a good philosophy of science reveals and analyzes the morally and politically neutral production of good science. This metaphilosophical norm insures that the philosophy of science (1) is blind to the influence of non-cognitive values on good science if and when these are present and so (2) acquiesces in the moral or political arrangements supported by the science in question. This thesis aims to bring methodological issues in the debate about the nature of fictional characters to the fore. I show how the arguments fictional realists have offered in favour of their views rely on crucial ‘metaontological’ assumptions about what ontological questions are and how they should be answered. In addition to casting doubt on some of the more orthodox approaches to ontological inquiry, my positive goal is to deploy an independently motivated metaontology to defend a novel version of fictional (...) anti-realism. On the view I develop and defend, the central task we face is that of explaining truths concerning fictional characters, where the relevant notion of explanation is distinctively metaphysical in character. Fictional anti-realism emerges as the plausible thesis that truths about fictional entities can be completely explained in terms of the existence and features of other things. (shrink)

This paper examines the principle of creation ex nihilo as formulated by St. Augustine and contrasts it with the common-sense principle that “something cannot come from nothing.” It is argued that these two principles, if suitably interpreted, are logically consistent and a creation scenario is described in which their compatibility is demonstrated.

This paper provides an overview of the development of Jewish studies in Germany since reunification. After a brief historical review of the subject in the nineteenth century with the development of modern Reform Judaism and the science of Judaism created by Jewish religious and secular scholars, it focuses on the development of the past thirty years, in which not only the Jewish community but also Jewish studies have increased in importance. The growth of the Jewish community was largely due to (...) immigration from the Soviet Union, but also partly to young Israelis who moved to Berlin. In line with these different backgrounds, a new interest in diaspora research emerged. The paper also deals with the difference between German Jewish studies and those of most other countries, where Jewish studies are mainly designed by Jewish scholars. (shrink)
